Terms & conditions

These Terms & Conditions govern use of the Furstatec Furniture website and the main conditions applying to retail orders, quotations, RFQs, tender-related requests and other transactions with Furstatec unless different written terms are specifically agreed.

1. Acceptance and scope

By using this website, creating an account, placing an order or submitting a quotation request, the user agrees to these Terms to the extent they apply to the relevant activity. A separate written quotation, purchase order, tender award or project agreement may add to or vary these Terms for that transaction.

2. Business identity and contact

The website is operated for Furstatec Furniture. Business enquiries can be sent to sales@furstatecfurniture.co.ke, by phone at 0143 397 929, or through the Contact page.

Current business location: Liberty Plaza, 1st Floor, Mombasa Road, Opposite The Imaara Mall, Nairobi, Kenya.

3. Product information and images

Furstatec aims to present product names, descriptions, images, categories, prices and other information accurately. Product images are intended to help customers understand the item, but screen colour, lighting, image perspective, natural material variation and production changes may cause minor differences between an image and the delivered product.

Dimensions, finishes, capacities, materials, ergonomic claims, certifications or warranties should be treated as confirmed only where they are expressly stated for the relevant product or in a written Furstatec quotation/specification.

4. Availability and product changes

Products may become unavailable, be discontinued, change price or require a different lead time. Adding an item to a cart does not reserve stock indefinitely. If a paid or confirmed order cannot be supplied as expected, Furstatec will contact the customer to discuss an alternative, revised timeline or refund as appropriate.

5. Prices, currency and charges

Website prices are displayed in Kenyan shillings (KSh) unless another currency is expressly stated. Delivery, taxes, project charges, customisation or other costs may be shown separately where applicable.

If a clear pricing or data-entry error is discovered before fulfilment, Furstatec may pause the affected transaction and contact the customer to confirm the correct price or cancel/refund the affected item rather than knowingly fulfil an obvious error.

6. Placing a standard online order

Where online purchasing is enabled, the customer selects products, provides required checkout information and submits the order. The customer is responsible for checking product, quantity, contact and delivery information before submitting.

Automatic website messages acknowledge that information has been received; where further stock, payment or delivery confirmation is required, Furstatec may contact the customer before fulfilment.

7. Order acceptance and cancellation by Furstatec

Furstatec may decline or cancel an order where the item is unavailable, payment cannot be verified, delivery is impracticable, there is a suspected fraud/security issue, the order contains a material pricing error, or another legitimate reason prevents fulfilment.

Where Furstatec cancels an order after receiving money for an unfulfilled item, the relevant amount will be refunded through an appropriate method.

8. Quotations, RFQs and tender requests

Bulk orders, office setups, procurement schedules, RFQs and tender requirements can be submitted through the Request a Quote route. A quotation is based on the information available at the time it is prepared.

A quotation may specify validity period, product specification, quantities, lead time, payment terms, delivery terms or other transaction-specific conditions. Those written terms form part of the transaction if the quotation is accepted.

9. Customer specifications and approvals

For customised, made-to-order or project furniture, the customer is responsible for reviewing and approving the stated dimensions, finish, colour, layout, quantity and other specifications before production or committed sourcing begins.

Furstatec is not responsible for a mismatch caused solely by inaccurate measurements, specifications or approvals supplied by the customer, except to the extent Furstatec expressly accepted responsibility for measuring or designing the relevant requirement.

10. Payment

Current payment arrangements include cash/M-PESA on delivery and bank transfer. A quotation or order may contain a different agreed payment schedule for custom, bulk, institutional or project purchases.

A customer should use only payment instructions confirmed through Furstatec’s official channels. If payment details appear unusual or unexpectedly change, contact Furstatec before sending money.

11. Delivery, assembly and customer collection

Delivery, assembly, failed-delivery and collection arrangements are described in the Delivery Information policy. Transaction-specific written delivery terms take precedence where expressly agreed.

12. Risk and responsibility after handover

Customers should inspect goods at handover. Once goods have been delivered or collected and accepted, the customer is responsible for reasonable care, safe use and protection of the products, subject to any continuing rights relating to defects, incorrect supply or other matters that remain Furstatec’s responsibility.

13. Returns, exchanges and refunds

Returns, exchanges, defects, restocking charges and refunds are governed by the Returns & Refunds Policy together with any mandatory legal rights.

14. Warranties and product care

A commercial warranty applies only where Furstatec or the manufacturer expressly states one for the relevant item. Customers should follow reasonable product-care, assembly and use instructions. Damage caused by misuse, unauthorised alteration, unsuitable environment or failure to follow applicable care instructions may fall outside a commercial warranty.

15. Customer accounts and account security

Customers who create website accounts are responsible for keeping login credentials confidential and for notifying Furstatec if they reasonably believe the account has been compromised. Furstatec may suspend or restrict an account where necessary to investigate misuse or protect the website.

16. Acceptable website use

The website must not be used to attempt unauthorised access, introduce malware, overload website infrastructure, scrape or copy content in a way that violates applicable rights, submit fraudulent orders, upload malicious files or interfere with another user’s access.

Furstatec may block or restrict activity reasonably believed to threaten website security, other users or business operations.

17. Website content and intellectual property

Unless otherwise stated, Furstatec website branding, layout, original copy and site-specific design materials are protected by applicable intellectual-property rights. Third-party product photographs, brand names and manufacturer materials remain the property of their respective owners where applicable.

Website content may be viewed and used for normal shopping, procurement and reference purposes. Republishing or commercially exploiting protected content without permission may infringe applicable rights.

18. Third-party services and links

The website may use or link to third-party services such as maps, couriers, analytics, advertising platforms, payment/banking services or social/communication platforms. Third-party services operate under their own terms and privacy practices.

19. Website availability and errors

Furstatec aims to keep the website available and accurate but does not promise uninterrupted or error-free operation. Maintenance, hosting incidents, internet outages, software faults and circumstances outside Furstatec’s control may temporarily affect access.

20. Liability and mandatory rights

Nothing in these Terms excludes or limits liability or consumer rights where exclusion is prohibited by law. To the extent legally permitted, Furstatec is not responsible for indirect or consequential loss arising solely from website downtime, third-party service failure or customer misuse of products.

Where Furstatec is legally responsible for defective goods, incorrect supply or another breach, the available remedies are determined by the circumstances, the agreed transaction terms and applicable law.

21. Events outside reasonable control

Furstatec is not expected to perform an obligation on the original timetable where performance is prevented or materially delayed by an event outside reasonable control, including severe weather, transport disruption, public restrictions, supplier interruption, industrial action, security incidents, major system outages or similar events. Furstatec will make reasonable efforts to communicate material effects and resume performance when practicable.

22. Complaints and dispute resolution

Customers should raise a complaint through Furstatec’s contact channels or sales@furstatecfurniture.co.ke, providing enough information for the issue to be investigated. Furstatec will aim to resolve genuine complaints in a practical and fair manner.

23. Governing law

These Terms and Furstatec transactions are governed by the laws of Kenya, subject to any mandatory rights or jurisdiction rules that apply to a particular customer or transaction.

24. Changes, severability and no waiver

Furstatec may update these Terms when business processes, website features or legal requirements change. If one provision is found unenforceable, the remaining provisions continue to apply to the extent legally possible. A delay in enforcing a right does not automatically mean that the right has been permanently waived.
